As you know, by the additional clause 2nd and provisional article 23rd of Unemployment Insurance Code No. 4447 the conditions of short-time working pay are regulated to decrease the effects of Covid-19 in business life. Pursuant to these provisions, with respect to Presidential Decree No. 2706 published in the official gazette dated 30th June 2020, conditions of making a new application and compliance test are not required for businesses that have applied until 30th June 2020, with the same employees and the same stipulations.
Besides, for the workplaces which already expired the period of short-time working as of the publication date of the Presidential Decree, it has been extended for 1 (one) month from 1st July 2020; for the workplaces that continuing the short-time working as of the publication date of the Presidential Decree, the period has extended for 1 (one) month but from the due date of short-time working period.
Besides, the prohibition of termination of employment contracts that regulated in the subclause 1st of provisional article 10th of Labour Law No. 4857 and employer’s right to give unpaid leave that regulated in the 2nd subclause of the same Law, are extended 1 month. Pursuant to these provisions, termination of employment contracts can be carried out only with the rowed reasons in the 2nd subclause of article 25 of Labour Law No. 4857 titled “Reasons that do not comply with morality and goodwill''.
